Many Worry, HB 3200 Destroys Health Care System, Constitutional Attorney Says it Destroys Constitution

Retired Constitutional Attorney Michael Connelly has read the entire text of House Bill 3200: The Affordable Health Care Choices Act of 2009. He warns Americans that not only is this bill dangerous to your health, it is even more dangerous to the health of our already ailing U. S. Constitution. According to Mr. Connelly, “What I found was far worse than what I had heard or expected.”

It is no wonder that the Democrats have been unwilling to open this bill to the scrutiny of the American people. Most of what they are saying about the compromise bill is not true. According to Michael Connelly the bill still contains measures for rationing health care, there is still provision for health care to illegal immigrants, and free abortion services are still in the bill, including forcing health care professionals to participate in an abortion even if they oppose abortion on religious grounds. Finally, House Bill 3200 will eventually force everyone into a government-run heath care system, by putting private insurance companies out of business. It seems the Democrats have been telling the truth about a government option. There is no government option in this bill. It seems to be a government mandate with, eventually, no private option available.

Despite these problems with House Bill 3200, the most deadly affects of this monstrosity is the affect that it will have on the U. S. Constitution. House Bill 3200 provides access to such areas of your private information as health care, financial records, employer, and all your caregivers. The fourth Amendment to the Constitution protects Americans from “unreasonable search and seizures” and your right to privacy. You can say good-bye to those provisions of the Constitution if this bill passes.

Should you wish to not participate in this health care scheme, you will have a “tax” imposed on you. In the words of Attorney Connelly, “it is called a tax instead of a fine because of the intent to avoid application of the due process clause of the fifth Amendment.” As he says, though, since there is no provision to avoid this tax, other than submit to the tyranny of a government monopoly in health care, this bill is killing the “due process” clause of the fifth Amendment.

When Randy Pope was sworn in as a City Councilman, he emphasized the phrase, “I swear to uphold and defend the Constitution of the United States of America.” As a City Councilman he received much grief from his colleagues in elected office when he voted no on some ordinances, “just because he believed them to be unconstitutional.” It is saddening that most elected officials have no more respect for themselves that they do not consider the gravity of their oath to uphold and protect the Constitution. You are seeing once again, as Congress prepares to complete the greatest transfer of power to the Executive Branch of government in U. S. History, the modern day elected officials' contempt for the Constitution.
